This page is long. Some may say its boring. But this page is the terms and conditions that clients will be agreeing to when they buy a program. It isn’t often but now and then there are deals that will hang in the threads based on these terms. You need to know these terms.
Terms & Conditions
A. AGREEMENT
This ("Agreement") is by and between Wonder Dog Corp, (hereinafter referred to as “Wonder Dog”) and the Family Owner(s) of the Dog, (hereinafter referred to as “Client”) and entered into for the dual purpose of hiring Wonder Dog to instruct the dog owner(s) and dog handler(s) in the Wonder Dog methods of dog training so that the Client can train their dog in the limited scope defined below, as well as to enjoy the membership benefits of the Wonder Dog Tribe (hereinafter referred to as the “Tribe”).
B. SCOPE OF SERVICES & RESOURCES PROVIDED BY WONDER DOG
Wonder Dog will NOT work with aggressive or reactive dogs, which is defined by dogs who have any history or are showing signs of biting, lunging or excessive barking towards other dogs or people.

Wonder Dog will provide dog training, coaching & social environments for dogs to grow, socialize and learn to obey around distractions. While we certainly train dogs during lessons, the vast majority of the training comes from the Client who is agreeing to practice the exact techniques we have modeled and shown them for at least 20 minutes a day between lessons. It will only be through this much repetition that the dog will be trained to the stimuli that we are using.
Wonder Dog will teach Client and Client’s dog the 7 basic obedience commands of sit, stay, down, place, come, heel and release, as well as helping the Client reduce the risk of certain unwanted behaviors such as bolting out the door, jumping on guests, counter surfing, going potty inside, pulling on the leash, nipping (play biting) and scratching and digging. This training may be done through private lessons and/or group lessons or games with a dog trainer, and must be re-enforced by daily homework assignments executed by the Client, possibly using stimuli from all 4 quadrants of operant conditioning, including uncomfortable stimuli from a prong collar, remote electronic collar, pet corrector horn or by merely using unpleasant vocals. This training could be done through our on-leash or off-leash dog obedience lesson programs, or through our video training programs, or even a hybrid of the two.
If the optional “Accelerator" program is purchased, it entitles the Client to the same results of the program that they purchased, but at an accelerated timeframe, normally meaning more than one lesson a week. If the more frequent lessons are not used, then any refund will be the sole discretion of Wonder Dog based on the actual frequency of the lessons.
If the optional “Customized Potty Plan” option is purchased, then Wonder Dog will teach the Client how to potty where the Client desires and/or help reduce the risk of the dog potting elsewhere. Due to the abbreviated nature of this isolated program, all guarantees of results are nullified.
If the optional “Single Lesson” option is purchased, then Wonder Dog will spend one lessons teaching the Client and the Client’s dog one of the 7 basic life commands and/or help reduce the risk of one isolated unwanted behaviors that was defined during the evaluation. Due to the abbreviated nature of these isolated lessons, all guarantees of results are nullified.
If the optional “2-Lesson” option is purchased, then Wonder Dog will spend two lessons teaching the Client and the Client’s dog two of the 7 basic life commands and/or help reduce them risk of two isolated unwanted behaviors that were defined during the evaluation, or a combination of those, but limited only to what we can realistically do in just 2 lessons. Due to the abbreviated nature of these isolated lessons, all guarantees of results are nullified.
If the optional “Regression Lesson” option is purchased for Lapsed Tribe Members, then Wonder Dog will spend one lesson teaching the Client and the Client’s dog one of the 7 basic life commands and/or help reduce them risk of one isolated unwanted behaviors that was defined during the evaluation. Due to the abbreviated nature of these isolated lessons, all guarantees of results are nullified.
If the optional “Gift Certificate” is purchased as a gift, it will be transferrable to any other dog for up to twenty-four months from the date it was purchased - given that the Client and the dog meet our minimum requirements of not being ill, not aggressive, not reactive and that the dog’s family will be actively engaged so that they can do the homework, etc.
10.If the optional “Basic Tribe Membership” is purchased, then Wonder Dog will grant access to educational materials, videos, articles, affiliate recommendations with possible commissions to us, events, newsletters and discounts to merchandise, along with other potential benefits in the future.
11.If the optional “Premium Tribe Membership” is purchased, then Wonder Dog will grant access to educational materials, videos, articles, affiliate recommendations with possible commissions to us, events, newsletters, discounts to merchandise and regression insurance. The regression insurance entitles the Client to coaching over the phone or a refresher lesson to help them re-enforce whichever of the 7 life commands needs strengthening, or to help further reduce the isolated unwanted behaviors that were identified during the evaluation.
C. ACKNOWLEDGEMENTS & AGREEMENTS
By paying Wonder Dog for a dog obedience program, isolated lessons, a Tribe membership or even putting a card on file with us for a free trial of the membership benefits, the Client agrees to and understands all of the terms & conditions of service by Wonder Dog on behalf of themselves and their entire household and any one who handles their dog or anyone they bring to a Tribe’s event, and agrees that they are permitted to make decisions on the dog’s behalf and the family’s behalf.
Client also agrees that the FIRST same-day cancellation, reschedule or no-show of a scheduled lesson, for any reason whatsoever, will result in a $50 fee, increasing by $50 for each time after that. A “no call, no show” means that (i) the Client did not inform Wonder Dog that the lesson needed to be cancelled, rescheduled, or postponed and the dog trainer arrived to (ii) the Client's home or agreed upon lesson location, and (iii) the dog owner and the dog were not present.
Client further agrees that follow-up and scheduling of future training sessions is their sole responsibility.
Client attests and agrees that dog has not been exposed to distemper, rabies, parvovirus, within the past thirty (30) days, and that the dog’s deworming shots and vaccinations are up to date.
Client agrees to be fully prepared and on-time for all scheduled sessions, as well as to fully cooperate in completing the training program with at least one adult handler, or better, the entire household present at each lesson.
Client agrees to make each of the household members to practice the necessary homework assignments with the dog(s) as given by the trainer.
The agrees that practicing exactly what the trainer teaches them between lessons is the mission-critical task to accomplish the agreed upon goals and objectives of the training program.
Client also agrees that Wonder Dog has NOT represented, promised, guaranteed or warranted that the Client’s dog has the full capacity to be trained, or or that the Client’s dog will always obey each command consistently, or that the Client’s dog will never repeat the problem behaviors again, or that the Client’s dog will never bite or lunge or reactively bark or be dangerous in any way or reactive in the future, or that the Client’s dog will not exhibit other behavioral problems such as expressing anxiety, clawing, scratching, digging or eliminating in the home, or that the Client’s dog will be taught special tricks or commands in addition to the 7 life commands stated above, or that the training will last for any particular amount of time as each dog is different in regards to ability, breeding and temperament.
Client also agrees that training lessons have no cash value, nor can they be transferred to any other dog.
Client agrees that all media, including pictures, videos, texts, emails, social media posts or any other kind of capture of their likeness or their dog’s likeness during the program or at any of Company’s events may be manipulated and used however Wonder Dog wishes. Any such media are the exclusive property of Wonder Dog. Client releases Wonder Dog from any claims which Client has or may have for invasion of privacy, right of publicity, defamation, copyright, infringement or any other cause of action arising out of the use, distribution, reproduction, broadcast or exhibition of such pictures, videos or likenesses.
Client agrees and authorizes Wonder Dog to deliver to your cell phone numbers and/or email addresses and/or their social media messaging inboxes or using the inboxes on any future application or platform we use various communications using an automatic telephone dialing system, an artificial and/or a pre-recorded voice phone calls, text messages, voicemails, social media messages, videos, photos, buttons and emails advertising our services, products, events, promotions, appointments, recommendations for which we might earn commissions, educational materials and account information - all to which you can unsubscribe at any time.
Client agrees that as Wonder Dog occasionally changes the terms of service with future clients, that the new terms will void and will replace the old terms, retroactively applying to all past clients, without notice, so if the client wants to review their agreement with Wonder Dog, the Client will need to ask for the newest terms.
If the Client’s dog is regressing back to old behavior patterns while the Client is current on all dues to the Tribe Membership, and if the Client has done all of the homework assignments during the training program period, then the “regression insurance" entitles the Client to coaching over the phone or a group lesson, or if needed, a private refresher lesson to help them re-enforce whichever of the 7 life commands needs strengthening, or to help further reduce the isolated unwanted behaviors that were identified during the evaluation.
Client agrees that Wonder Dog does not guarantee any group or specialty class or dog games or Tribe events will always be held on a weekly schedule, or at any specific location, due to staffing, weather, or other various factors that demand the Company’s attention and consideration.
Client agrees that if Client's dog is aggressive, reactive, ill, unvaccinated or in-heat that the dog can be prohibited from attending Wonder Dog private lesson, group classes and Tribe events, and might even have the Client’s Program or Membership cancelled.
REASON FOR THE TERMINATION OF THE TRAINING PROGRAM AND/OR TRIBE MEMBERSHIP
1. Wonder Dog services shall terminate if:
(a) in Wonder Dog's sole judgment the Client’s dog is dangerous, aggressive and/or reactive towards Wonder Dog employees or any other person or animal, or interferes with the training of other dogs, or
(b) in Wonder Dog’s sole judgement the interpersonal relationships between dog or trainer or handler(s) are not proper in some way, or
(c) Client breaches any term or condition of this Agreement, or
(d) Client is consistently disengaged in the program, inattentive during lessons, tardy, absent, intoxicated in any way, not consistently doing the daily practice exercises or exhibiting any other behavior that is frustrating the effectiveness of the training program
(e) Client requests service termination. If this is the case, then the Client agrees that when the termination is executed that all of Wonder Dog’s duties and responsibilities shall terminate, but all other provisions of this Agreement shall remain in full force and effect, including but not limited to all payments that are still due to Wonder Dog by the Client, as well as all hold harmless agreement terms below.
2. Additionally, if at anytime during the training, Wonder Dog reasonably believes that the dog is ill, abused, neglected, living in filth, exhibiting aggressive, reactive, fearful, anxious, compulsive, phobic, or exhibiting any behaviors that may interfere or endanger the health or safety of any participants or bystanders, including the dog, or exhibiting any behaviors that limit the trainer’s ability to train the dog according to the full program goals, then Client agrees that Wonder Dog Corp may end any training lesson or the entire program and that Client will not be entitled to a refund.
3. In addition, the Client agrees that no portion of the program or event fees or Membership dues are refundable at any point after the initial consultation for any reason whatsoever, and that termination of the program and/or membership by either party also terminates all Training Programs, Group Classes and Games and Tribe membership privileges. This includes but is not limited to refunds for unused Membership access, events not attended, invite communications not getting through, forgetting to cancel the Membership, or the Company having to cancel the Membership for a dog that recently became aggressive or reactive and thus would then be untrainable by Wonder Dog even if having had been paying for the regression insurance, since neither party knew that this would be the case and the Client was able to enjoy the other privileges of Membership.
4. Client also agrees that the Wonder Dog Guarantee is a vague, good faith promise that allows the Company to consider what is fair and just in each situation, taking into account any offenses, broken promises from the Company, trainer or Client, as well as much many lessons have been completed and the value of the dog training gear the Client wants to keep after cancellation.
HOLD HARMLESS
1. Client assumes sole responsibility for the behavior of the dog and forever releases, holds harmless and agrees to indemnify Wonder Dog Corp, and its owners, employees, volunteers and trainers from any harm or damage caused by or to the handlers, the dog(s) or to any person or persons or property at any time, perpetually. This release includes, but is not limited to, any advice given to the handlers and/or any training given to the dog, as well as any falls, bites, scratches or scraps before, during or after any training lesson or Company event.
2. Client also agrees to hold Wonder Dog Corp, its owner(s), employee(s), or agent(s) free and harmless from any and all claims, liability, damage, loss, or expenses arising out of any injury to any person or to any person’s property by the dog(s) named in this contract, while in the care, custody and control of the client, and/or dog owner, or while in the care, custody and control of Wonder Dog Corp, its employee(s), owner(s) or agent(s), or while at any event hosted by Wonder Dog Corp.
LIMITATION AND LIABILITY
1. Client agrees understands and acknowledges that the elimination or modification of behaviors is not guaranteed. Client acknowledges that dog training will not provide exact results and that failure to follow the professional advice given to them by Wonder Dog Corp may result in an escalation of behavior and training issues.
2. Client further agrees to accept total responsibility for any damages the above named dog may cause through malicious, aggressive or improper behavior that may occur before, during or after all services provided by or events hosted by Wonder Dog Corp. Furthermore, Client understands and agrees that if their dog is injured in a dog fight or an accident, gets fleas, ticks or worms, contracts any illness or disease, is lost or stolen, becomes pregnant, or engages in any dangerous, vicious or unwanted behavior, during or after all services provided by or events held by Wonder Dog Corp, whether on or off Wonder Dog Corp premises, Client's home or business or any other location, that Client totally accepts the risk and agrees that Wonder Dog Corp shall not be held responsible for it or any resulting injuries, losses, damages, costs or expenses in any way whatsoever.
ARBITRATION
In the event a dispute shall arise between the parties to this Agreement, it is hereby agreed that the dispute shall be referred to The American Arbitration Association. The situs of the hearing shall be in Shelby County Tennessee for arbitration in accordance with The American Arbitration Association Rules and Procedures. The arbitrator's decision shall be final and legally binding and judgment may be entered thereon. Each party shall be responsible for its share of the arbitration fees in accordance with the applicable Rules of Arbitration. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator's award, or fails to comply with the arbitrator's award, the other party is entitled to costs of suit, including all reasonable attorneys’ fee for having to compel arbitration or defend or enforce the award.
Multi-stage - first, good faith efforts to resolve for at least 20 days; then non-binding mediation; then binding arbitration.
Non-Disparagement Clause - Trying to harm our business
Overly-burdensome to the other party, the judge will rule to come closer to market standards
Participation agreement -
SOLE AGREEMENT
This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Wonder Dog regarding the matters as described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to the Dog or anything else.
FINAL AGREEMENT
By paying this first invoice, Client acknowledges and agrees to all terms, conditions and legal provisions as set forth above which represents the entire agreement with Wonder
Dog. Furthermore, Client's initials and signature on this agreement are proof of their acceptance of this entire agreement. Client authorizes Wonder Dog Training & Services Inc to charge Client's credit card if it was provided as payment for services.
